The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 9/2025 registered at Police Station Bagru, District Jaipur (West) for the offence(s) under Sections 8/21 of NDPS Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. It is contended that the first bail application of the accused-petitioner was dismissed with liberty to file afresh after filing of the charge-sheet. The charge-sheet has already been submitted before the concerned court. It is also contended that the recovered quantity of smack from the possession of other co-accused is 11 grams

which is below commercial quantity. The other co-accused Rakesh Yogi has been enlarged on bail. It is alleged against the petitioner that she supplied the smack to the other co-accused and there is no substantive evidence available on the record indicating the involvement of the petitioner in the present case. The petitioner is a woman and behind the bar since 15.03.2025 and trial of the case will take considerable time. Therefore her second bail application may be allowed.

Learned Public Prosecutor opposed the bail application and contended that the petitioner is a habitual offender and against her two other cases under Section 8/21 of the NDPS were also registered. The accused-petitioner is also involved in transporting the illicit liquor and three charge-sheets have been filed under Section 19/54 of the Excise Act against her, therefore considering the criminal conduct of the petitioner, the second bail application of the accused-petitioner deserves to be dismissed.

Heard and perused the material available on the record.

The first bail application of the accused-petitioner was dismissed with liberty to file afresh after filing of the charge-sheet. Police has submitted the charge-sheet before the concerned court for the offence under Section 8/29 of the NDPS Act. The other coaccused Rakesh Yogi from whose possession 11 gram of smack was recovered has already been enlarged on bail. Considering the above fact, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mrs. Sarita Sansi W/o Late Shri Kiran Kumar, in connection with FIR No.

9/2025 registered at Police Station Bagru, District Jaipur (West) shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.

The accused is also directed to mark his presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned court.
