These instant fourth bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.113/2024 registered at Police Station Kaithun, District Kota Rural for the offence(s) under Sections 147, 148, 149, 341, 323 and 307 of IPC.

Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the petitioners have preferred these fourth bail applications on the grounds of delay in trial as out of 23 cited witnesses only 11 witnesses have been examined by the learned trial court. The accused-petitioners are in custody since long and the trial of the case may take considerable time, therefore, these fourth bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed these fourth bail applications and contended that the petitioners's third bail applications were dismissed by detailed order dated 24.01.2025 and thereafter, the trial has proceeded. The allegations against the petitioners are grave and petitioners along with the other co-accused assaulted injured- Shokat Ali and Mustafa and as a result of assault, Mustafa sustained 3 grievous injuries, therefore, these fourth bail applications of the accusedpetitioners may be dismissed.

Heard and perused the material available on record. 5. The third bail applications of the accused-petitioners were dismissed vide order dated 24.01.2025 for considering the merits, thereafter, the trial has proceeded and 5 more witnesses have been examined, therefore, this Court is not inclined to enlarge the accused-petitioners on bail.

Hence, these fourth bail applications of the accusedpetitioners are hereby, dismissed.
