The instant 2nd bail application has been filed under Section 483 of the BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.147/2024 registered at Police Station Sadar Baran, District Baran for the offences under Sections 323, 307, 397, 506 & 34 IPC and Section 3/25 Arms Act.

First bail application of the petitioner bearing S.B. Criminal Misc. Bail Application No.12188/2024 was dismissed as withdrawn by this Court vide order dated 08.10.2024 with liberty to file fresh bail application after examination of the complainant.

Considered the submissions made at bar and also perused the material available on record.

The complainant/injured witness-Anil Mehta has been examined as PW-1. As per his statement recorded before the learned trial Court, the allegation of inflicting firearm injury is

against co-accused. The allegation as borne out from the statements of the complainant-witness is that the accusedpetitioner alongwith other co-accused has inflicted injury and ran away with the co-accused. On of the co-accused, namely, Ramchandra @ Baba has already enlarged on bail by this Court vide order dated 12.03.2025 in S.B. Criminal Misc. 2nd Bail Application No.3494/2025.

Taking into consideration overall facts and circumstances of the case and more particularly the fact that there is no allegation against the petitioner of inflicting any injury to the complainant and he is in custody since 17.05.2024 and the co-accusedRamchandra @ Baba has already been enlarged on bail, this Court without expressing any opinion on the merits/demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, the 2nd bail application under Section 483 of the BNSS is allowed and it is ordered that the accused-petitioner named above in connection with the aforesaid FIR shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
