The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.117/2025 registered at Police Station-Jhotwara, District-Jaipur (West) for the offences under Section 307 BNS, 2023. Since all these bail applications arise from common order, hence, they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. All petitioners are of tender age. Counsel further submits that there is no previous cases are registered against them. So called recovery was shown just to implead the accused on bogus grounds. No identification parade was conducted. Petitioners-Vijay Sain, Rajendra Singh @ Raj, Rahul Singh Shekhawat @ Happy Singh are behind the bars since 17.02.2025, petitioner-Rajendra Singh Urf Rajveer is behind the bars since 18.02.2025 and petitioner-Pintu Sain is behind the bars since 23.02.2025. Charge-sheet has been filed. The trial of the case may take considerable time, hence the bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners -Rajendra Singh @ Raj S/o Shri Ladu Singh, Rajendra Singh Alias Rajveer S/o Mahaveer Singh, Pintu Sain S/o Pappu Lal, Rahul Singh Shekhawat @ Happy Singh S/o Shri Rajendra Singh Shekhawat, Vijay Sain S/o Ramavtar Sain and Rajendra Singh Urf Rajveer S/o Mahaveer Singh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each of them to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
