The instant second bail application has been filed under Section 483 of BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 606/2023 registered at Police Station Jawahar Circle, District Jaipur City (east) for the offence(s) under Section 384 of IPC.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. It is alleged against the petitioner that he supplied phone number of complainant Dr. Sunit Shah to main accused Gautam Arora. The police has not recovered any mobile-phone containing the fact that petitioner has furnished the phone number of Dr. Sunit Shah to the main accused Gautam Arora. The main allegation of threatening the complainant and demanding Rs. 50,00,000/- (Fifty

Lakh) is against other co-accused Gautam Arora. The accused petitioner is in custody since 16.09.2023, other similarly placed co-accused has already been enlarged on bail. The charge-sheet against the petitioner was submitted on 10.11.2023 before the concerned court thereafter trial has not proceeded and only charges were framed against the accused-petitioner till now and trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor opposes the bail application and contended that the petitioner is a member of lawrence bishnoi gang and was found to be involved in furnishing information to the main accused Gautam Arora who threatened the complainant and demanded Rs. 50,00,000/-(fifty lakh), therefore, considering the allegation against the petitioner, the second bail application of accused-petitioner deserves to be dismissed.

Heard and perused the material available on the record.

It is not desirable to express anything on the merits of the case. Accused-petitioner is in custody since 16.09.2023 and trial of the case will take considerable time. The direct allegation of threatening the complainant Dr. Sunit Shah and demanding Rs. 50,00,000/-(fifty lakh) is against co-accused Gautam Arora. Apart from the information furnished under Section 27 of the Evidence Act, there is no other substantive evidence available on the record indicating the fact that petitioner has furnished the mobile number of Dr. Sunit Shah to the main accused Gautam Arora. Though there are pending cases shown against the

petitioner, considering the long incarceration, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ravindra Singh @ Kalli Shooter S/o Raghunath Singh, in connection with FIR No. 606/2023 registered at Police Station Jawahar Circle, District Jaipur City (east) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
