The petitioners have filed these bail applications under Section 483 of BNSS in FIR No. 6/2025 registered at Police Station Viratnagar District Kotputali-Behror for offence under Sections 8/21 of NDPS Act.

Since both these cases arise out of common order, hence they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the alleged contraband recovered is below the commercial quantity. There are two other cases pending against the petitioner Tarun @ Vikki in which he has been acquitted. Charge-sheet in this case has been filed. The petitioner is behind the bars since 6.1.2025. In so far as petitioner Sanjay Kumar is concerned no recovery has been effected from him and he is behind the bars since 30.2.2025. The trial of the case will take considerable time, therefore, the bail applications of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail applications under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Tarun @ Vikki and Sanjay Kumar be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
