The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.20/2025 registered at Police Station-Udyog Nagar (Bharatpur), District-Bharatpur for the offences under Sections 109(1), 308(5), 309(4) of BNS, 2023 and Section 3/25 Arms Act. Since both the bail applications have arisen from common order, hence, they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that in these cases, FIR was registered against the present petitioners by complainant-Dheeraj Sharma to whom as per FIR itself, no injury have caused. The complainant has filed a compromise before the trial Court then too, the trial Court has rejected the bail application erroneously. In support of his contention, he has filed the original affidavit of complainant in which complainant has specifically stated that he does not want any legal proceedings against the present petitioners in the present FIR. Petitioners are behind the bars since 24.01.2025 and charge-sheet has been filed. The trial of the case may take considerable time, hence the bail application of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners -Gopal S/o Digamber Singh and Kripal Singh S/o Ajay Singh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each of them to the

satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
