been filed by the accused-petitioners under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in respect of FIR No.320/2025 registered at Police Station-Pilani, District-

Jhunjhunu, for the offences punishable under Sections 109(1), 111(3), 308(5), 351(2), 351(3), 61(2)(a), 118(1) & 62 of Bharatiya Nyaya Sanhita, 2023 and Section 27 of Arms Act, 1959. 2. Learned counsel for the petitioners submits that the both the petitioners have falsely been implicated in the instant criminal case, whereas, they have not committed the offences alleged against them. He also submits that no recovery of any weapon whatsoever has been made from the petitioners. He further stated that without there being any conclusive material, allegation of hatching conspiracy has been alleged against the petitioners.

Learned counsel for the petitioners further submits that the contents of FIR are explicitly clear, where allegations of causing the offence is on other co-accused and not on petitioners. Petitioners are behind the Bars since 04.12.2025 and there are no criminal antecedents against the petitioners of the similar nature, therefore, the accused-petitioners may be allowed to be enlarged on bail.

Learned Public Prosecutor has opposed these present bail applications.

Having heard learned counsel for the petitioners as well as learned Public Prosecutor and in view of that fact that petitioners were not named in the FIR-in-question as well as no recovery of weapon whatsoever has been effected from them, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioners on bail.

Accordingly, these Bail Applications are hereby allowed.

The accused-petitioners Pankaj @ Tony S/o Rajveer Singh & Shekhi S/o Shri Hazari Lal shall be released on bail in pursuance of FIR No.320/2025 registered at Police Station-Pilani, District-Jhunjhunu on furnishing a personal bond of Rs. 1,00,000/each along with two sureties of Rs.50,000/- each. That apart, the accused-petitioners shall also follow the conditions as under:-

(i) They shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) They shall not leave the country without prior permission of the Court.

¶37

(iii) They shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless their presence is exempted by the trial Court.
