This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.434/2025 registered at Police Station Rudawal, District Bharatpur for the offence punishable under Sections 115(2), 126(2), 189(2), 351(2), 352, 324(4), 303(2), 329(4) BNS.

Learned counsel for the petitioner submits that petitioner is a lady aging 42 years and in the FIR itself there is no allegations of causing any assault by the petitioner to anybody. In fact its a matter where on account of same incident, cross FIR has been lodged by both the side. The petitioner is behind the bars since 05.12.2025 and trial against the petitioner is likely to take considerably long time. Hence, a prayer has been made to grant bail to the petitioner.

Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed this bail application.

Considered the submissions made at Bar.

In light of the fact that petitioner is a lady and there is no specific allegation in the FIR of causing any hurt or injury by the petitioner to anybody, hence, without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Accordingly, this Bail Application is hereby allowed. The accused-petitioner Kishanvati W/o Mukesh shall be released on bail in pursuance of FIR No.434/2025 registered at Police Station Rudraval, District Bharatpur on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:-

(i) She shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) She shall not leave the country without prior permission of the Court.

¶24

(iii) She shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless her presence is exempted by the trial Court.
