This second bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.9/2024, registered with the Police Station Sone Ka Gurja, District Dholpur for offences under Sections 147, 148, 149 & 307 of IPC.

First bail application of the petitioner bearing S.B. Criminal Misc. Bail Application No.9587/2024 was dismissed by this Court as withdrawn vide order dated 02.09.2024 with liberty to file afresh after examination of the complainant witness before the trial Court.

Heard.

As per the submission made by counsel for the petitioner, the complainant has been examined as PW.1 and other material witnesses namely Deshraj and Ajay Pal have been examined as PW.2 and PW.3 respectively.

Considered the submissions made at bar and also perused

the challan papers as well as the statements of prosecution witnesses named so far.

As per the statement of the complainant/PW.1 and other prosecution witnesses PW.2 & PW.3, the allegation of inflicting fire arm injury to Dharmveer is against Deviram and not against the petitioner.

Having regard to the submissions made by learned counsel for the petitioner and considering the version of the prosecution witnesses PW.2 & PW.3 and the fact that accused-petitioner is in custody since 12.06.2024, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
