This bail application has been filed by the petitioner under Section 483 of the B.N.S.S., arising out of F.I.R. No.395/2024, registered with the Police Station Lalshot, District Dausa for offences under Sections 303(2) of B.N.S.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and is in custody for about last more than one and a half months. Counsel further submits that the offences as alleged against the petitioner are triable by the Magistrate. Counsel also submits that co-accused Chensingh @ Chenya has already been enlarged on bail by this Court vide order dated 23.09.2024 passed in S.B. Criminal Misc. Bail Application No.11626/2024 and co-accused namely Rajesh and Ramlal @ Pilot have also been released on bail by this Court vide

order dated 09.10.2024 passed in S.B. Criminal Misc. Bail Applications Nos.11978/2024 & 11980/2024 respectively, therefore, the present petitioner may be released on bail.

Learned Public Prosecutor appearing for the State opposed the bail applications.

Considered the submissions made by learned counsel for the petitioners as well as the learned Public Prosecutor.

Co-accused persons namely Chensingh @ Chenya has already been enlarged on bail by this Court vide order dated 23.09.2024 passed in S.B. Criminal Misc. Bail Application No.11626/2024 and co-accused namely Rajesh and Ramlal @ Pilot have also been released on bail by this Court vide order dated 09.10.2024 passed in S.B. Criminal Misc. Bail Applications Nos.11978/2024 & 11980/2024 respectively.

Having regard to the submissions made by learned counsel for the petitioner so also the fact that the offences as alleged against the petitioner are triable by the Magistrate and also the fact that co-accused persons have already been released on bail, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he shall furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/(Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial
