The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 40/2024 registered at Police Station SOG, Jaipur District Jaipur for the offence under Sections 420, 467, 468, 471 and 120-B of IPC and Section 66-D of IT Act.

Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. There is no iota of evidence available on record against the petitioner that petitioner forged Taekwondo certificate in the favour of other coaccused and there is no criminal antecedent against the petitioner. Co-accused Manoj Kumar has already been enlarged on bail and offences alleged to have been committed by the petitioner are

triable by Magistrate. The accused-petitioner is in custody since 10.10.2024 and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor opposes the grant of bail application and submitted the factual report. It is contended that petitioner had issued forged tie-sheets and on the basis of that forged certificates were issued and the other co-accused appeared in the examination conducted by Rajasthan Directorate Education, therefore his bail application deserves to be dismissed.

Heard and perused the material available on record.

Considering the arguments advanced by the counsel for the parties and looking to the fact that the petitioner is in custody since long and and case of the petitioner is triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Dinesh Jagarwal S/o Shri Onkar Mal, in connection with FIR No. 40/2024 registered at Police Station SOG, Jaipur District Jaipur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
