The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.40/2024 registered at Police Station, Pratap Nagar, District Jaipur Metropolitan (East) for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. It is argued that the petitioner is a lady and she is in custody since 05.08.2024. The matter is exclusively triable by Magistrate, therefore, considering the long incarceration of the accused-petitioner and being lady, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the petitioner is found to be involved in various cases of similar nature and the learned trial

Court in the impugned order has also mentioned that as many as five criminal cases are pending against the petitioner, therefore, considering the criminal antecedents of the accused-petitioner, her bail application deserves to be dismissed.

Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case and considering the period of long incarceration and taking into account that trial of the case may take considerable time and the matter is exclusively triable by Magistrate, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner -Smt. Laxmi Kanwar W/o Shri Mahaveer Singh Shekhawat, in connection FIR No.40/2024 registered at Police Station Pratap Nagar, District Jaipur Metropolitan (East), shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
