The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 319/2025 registered at Police Station Gumanpura District Kota for the offence(s) under Sections 8/21 NDPS Act.

Learned counsel for the accused-applicant has submitted that applicant is a young man aged 26 years and sole bread earner of the family. It is further submitted that contraband is recovered from the co-accused, who has already been granted benefit of bail. It is also submitted that recovered quantity of the contraband is less than the commercial quantity. It is also submitted that applicant is in custody ever since 23.09.2025. Furthermore, it is submitted that applicant is ready to abide by the conditions imposed by this Court.

Per contra , learned Public Prosecutor has vehemently opposed the bail application. It is submitted that there are 14

criminal antecedents registered against the accused-applicant and he is threat to society.

Considering the arguments advanced by the counsel for the parties, considering that recovered quantity of the contraband is less than the commercial quantity; that accused-applicant is a young man aged 26 years; that accused-applicant is in custody ever since 23.09.2025; that the co-accused from whom contraband is recovered, has already been enlarged on bail and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Shohel Khan @ Sohel Manjar S/o Nijamuddin shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.

Considering the criminal antecedents registered against the accused-applicant, this court deems it fit to direct the accusedapplicant to reside for a period of six months at a distance of 250 Kms, from the place of his present residence and periodically mark attendance at the concerned Police Station once on every 5th of the month.
