The present bail application has been filed by the accusedapplicant under Section 483 of the B.N.S.S, 2023 against the order dated 08.10.2024 passed by learned Sessions Judge, Kota (Rajasthan) in connection with FIR No.99/2024, registered at Police Station Jawahar Nagar (Kota City), District Kota City for the offences punishable under Sections 420, 406 & 120-B of IPC, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.

Learned counsel for the accused-applicant submitted that the charges against the accused-applicant are for the offences punishable under Sections 420, 406 & 120-B of IPC, which are triable by the Judicial Magistrate. Learned counsel further submitted that the charge-sheet has been filed and trial will take

long time to conclude. Learned counsel for the accused-applicant argued that the accused-applicant is behind the bars since long, therefore, the accused-applicant be granted benefit of bail.

Learned Public Prosecutor vehemently opposed this bail application and submits that the accused-applicant by deceitful means has received Rs.43 Lacs from the complainants in lieu of arranging a new Hyundai Creta and Toyota Fortuner vehicles for the complainants. Learned Public Prosecutor further submits that three other criminal cases are also registered against the accusedapplicant, therefore, he should not be granted benefit of bail.

Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case, and considering the fact that the charges levelled against the accused-applicant are for the offences punishable under Sections 420, 406 & 120-B of IPC, which is triable by the Judicial Magistrate and also considering the fact that the accusedapplicant is behind the bars since long as well as considering the fact that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.

Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Santosh Singh S/o Trilokinath , arrested in FIR No. 99/2024, registered at Police Station Jawahar Nagar (Kota City), District Kota City shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested

sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
