This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.279/2025 registered at Police Station Beawar City, District Beawar for the offence punishable under Section 304(2) B.N.S.

It is stated by learned counsel for the petitioner that recovery of the gold locket has been effected at the instance of co-accused Arun, and the petitioner has been falsely implicated in the instant matter. No further recovery is to be made from the petitioner and investigation against the petitioner is complete. He is behind the bars since 25.08.2025 and the offence alleged is triable by Magistrate. Hence, a prayer has been made to grant bail to the petitioner.

Learned Public Prosecutor has vehemently opposed this bail application.

Considered the submissions made at Bar.

In light of the fact that the allegation in FIR is of locket snatching and the same has also been recovered at the instance of co-accused Arun and the offence alleged against the petitioner is triable by Magistrate. After recovery of the locket, no further investigation is required from the petitioner and trial against the petitioner is likely to take considerably long time, this Court, without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail.

Accordingly, this Bail Application is hereby allowed. The accused-petitioner Mohitpal Singh Alias Monu S/o Sh. Durga Singh Chouhan shall be released on bail in pursuance of FIR No. 279/2025 registered at Police Station Beawar City, District Beawar on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:-

(i) He shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) He shall not leave the country without prior permission of the Court.

¶23

(iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court.
