This criminal misc. bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.14/2024 registered at Police Station Jhalrapatan District Jhalawar for the offences punishable under Section 3, 5, 6, 8 & 9 of Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995.

It is submitted by learned counsel for the petitioner that bare perusal of FIR would reveal that the allegations are against one Shri Santosh Singh S/o Premnarayan, who has been shown as driver of the vehicle and name of the petitioner has not been mentioned in the FIR. Learned counsel further submits that co-accused driver Santosh Singh has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated

19.03.2024 passed in S.B. Criminal Miscellaneous Bail Application No.2773/2024 and even the other co-accused namely; Punit Tripathi & Mubarik have also been granted benefit of bail vide order dated 19.01.2024 passed by the learned Seesions Judge, Jhalawar (Raj.) in Criminal Miscellaneous Bail Application No.33/2024. He submits that petitioner's case is rather stands on better footings than the aforesaid co-accused, hence, he prayed for enlarging the petitioner on bail.

Learned Public Prosecutor has vehemently opposed this bail application.

Considered the submissions made at Bar.

In the light of the fact that name of the petitioner has not been mentioned in the FIR and the other co-accused, who has been assigned overact in the FIR, has already been enlarged on bail along with two other co-accused, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail.

Accordingly, this Bail Application is hereby allowed. The accused-petitioners Kamruddin Urf Kamru S/o Nassruddin shall be released on bail in pursuance of FIR No. 14/2024 registered at Police Station Jhalrapatan District Jhalawar on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:-

(i) He shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) He shall not leave the country without prior permission of the Court.

(iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court.
