Criminal Miscellaneous Bail Application No. 12980/2025 has been filed under Section 483 BNSS on behalf of accused-applicant, wherein the accused-applicant was arrested in connection with FIR No. 0552/2023 registered at Police Station Kotwali Baran District Baran for the offence(s) under Sections 420, 406 of IPC.

Learned counsel for the accused-applicant submitted that the applicant is 45 years of age and has only one criminal antecedent registered against him. It is further submitted that the applicant has been implicated in multiple repetitive FIRs lodged by different persons. It is also submitted that the charge-sheet has already been filed and the matter is triable by a Magistrate. It is further submitted that, in similar circumstances, a Co-ordinate Bench of this Court has granted bail, illustratively in S.B. Criminal Misc. Bail Application No. 12534/2025 titled Jitendra Kumar Nath vs. State of Rajasthan , decided vide order dated 24.11.2025.

Analyzing the matter, the Investigating Officer was called. It is apprised to the Court that two schemes of agricultural

plots, each measuring half a hectare, were initially floated. Plots valued at approximately Rs. 2.4 lakhs were sold to various persons, around 50 in number. However, it has been revealed that double pattas were issued for the same parcels of land, which has caused disputes among the purchasers.

Per contra , learned Public Prosecutor has vehemently opposed the bail application.

Considering the arguments advanced by the counsel for the parties, considering that charge-sheet has already been filed and the matter is triable by a Magistrate; that Co-ordinate Bench of this Court has granted bail to the Co-accused and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail with the condition that qua the alleged FIRs applicant is directed to deposit bank guarantee of Rs. One lakh each qua all the complainants.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Jitendra Kumar Nath S/o Shri Shankarnath shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
