The instant appeal has been filed under Section 14-A of SC/ST (Prevention Of Atrocities) Act on behalf of the appellants, who are in custody in connection with FIR No. 91/2024 Police Station Shahpura (Jaipur Rural), District Jaipur Rural for the offences under Sections 427, 447, 323, 341, 504 of IPC, read with Section 3(1) (F), (G) and 3 (2) (va) of SC/ST Act.

Vide order dated 21.05.2025 after considering arguments from respective sides and considering preliminary objection

pertaining to maintainability of anticipatory bail application in the matters of SC/ST Act more particularly under Section 18-A, of the Act after analyzing the prima facie case, interim bail application was allowed and directions were given for not taking any coercive action/arrest and by 28.05.2025 applicant was directed to join the investigation.

Learned counsel for the appellants has undertaken that appellants have joined the investigation and has submitted that against the said order qua the preliminary objection, no appeal as on date is filed or in his knowledge.

Learned counsel for the respondent has submitted that there was no need to prefer any appeal and the said order was binding and standard in nature. It is submitted that the petition filed under Section 528 of BNSS was challenged and the same was dismissed by the Hon’ble Supreme Court.

This Court has analyzed the facts that the Co-ordinate Bench of this Court on 21.05.2025 has passed a detailed order after considering arguments of both sides and even including the nonmaintainability of appeal and rejection of criminal miscellaneous petitions (under Section 528 of BNSS), thereafter interim was allowed which was in currency from a period of six months. Thence, at this stage, this Court is not inclined to interfere in the said order and the said order is made absolute.

Consequently, the instant appeal is allowed . The impugned order dated 22.04.2025 passed by the Special Judge, SC/ST (Prevention Of Atrocities) Cases, Jaipur in Anticipatory Bail Application No.66/2025 is set aside. It is ordered that the accused-

appellants Ramsingh Yadav Son Of Late Shri Banshi & Mamta Devi Wife Of Shri Ramsingh Yadav arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided they furnish a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
