The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 168/2008 registered at Police Station Kathumar District Alwar for the offence(s) under Sections 420, 406, 467, 468, 470, 120B of IPC.

Learned counsel for the accused-applicant has submitted that the matter at hand is triable by the Magistrate. It is submitted that the applicant is 65 years of age. It is submitted that there are total of three (03) criminal antecedents against the applicant, out of which the applicant is acquitted in one (01) of them. It is further submitted that applicant is behind bars ever-

since 05.09.2025. It is submitted that initially the FR was filed considering the fact that the nature of dispute is civil.

Learned Public Prosecutor as well as counsel for the complainant have opposed the instant bail application. 4. Considering the overall facts and without commenting upon the merits/demerits of the case, this Court is inclined to enlarge the accused-applicant on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Prabhati @ Hakam S/o Late Shri Ram Singh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
