This bail application has been filed by the accused-petitioner under Section 483 B.N.S.S., in connection with F.I.R. No.345/2024 registered at the Police Station Sapotra, District Karauli for the offences punishable under Sections 132, 121(1), 310(2), 189(2), 115(2) & 352 of BNS and Section 4/21 of the MMDR Act and Sections 41 & 42 of the Rajasthan Forest Act, 1953 and Section 27, 29 & 51 of the Wild Life Protection Act.

Considered the submissions made at Bar and also perused the material available on record.

The nature of allegation levelled against the accusedpetitioner is that he after making the attack on police party, rescued a tractor torlley loaded with Banas River sand.

Taking into consideration the allegation levelled against the accused-petitioner and so also the fact that the Police after completion of investigation has submitted charge-sheet in the matter and the accused-petitioner is in custody since 24.09.2024, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
