The instant bail application has been filed under Section 483 of BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 95/2023 registered at Police Station Shrinagar, District Ajmer for the offence(s) under Section 8/15 of the NDPS Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. He further submits that the recovered quantity of contraband articles i.e. poppystraw is 16KG, which is below commercial quantity. The accused-petitioner is in custody since 07.08.2025 and trial of the case may take considerable time. There are no criminal antecedents against the petitioner, therefore, the benefit of bail may be granted to the accused-petitioner.

Heard and perused the material available on the record.

Considering the arguments advanced by the counsel for the parties and looking to the fact that recovered quantity of contraband articles i.e. poppystraw is 16KG, which is below commercial quantity. The accused-petitioner is in custody since 07.08.2025 and trial of the case may take considerable time. There are no criminal antecedents against the petitioner, without commenting anything on the merits of the case, this court deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Kulwant Singh S/o Shri Gurucharan Singh, in connection with FIR No. 95/2023 registered at Police Station Shrinagar, District Ajmer shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
