The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 115/2025 registered at Police Station Ratlai, District Jhalawar for the offences under Sections 420 and 406 of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the allegation of deceiving the complainant on the pretext of granting employment in government service is false. The offences alleged against the accused-petitioner are exclusively triable by Magistrate. The accused-petitioner is in custody since 25.08.2025 and the trial of the case may take considerable time and there are no criminal antecedents against the accused-petitioner, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application and

contended that the petitioner on the pretext of granting employment in government services took money from many persons and said money was transferred in the account of Shanti Lal. It is also contended that pursuant to the complaint filed on 11.11.2024 before the P.S. Jhalawar, petitioner undertook the liability to return the money, however, the petitioner failed to return the same, therefore, considering the above facts, the bail application of the accused-petitioner may be dismissed.

Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that the offences alleged against the accused-petitioner are exclusively triable by Magistrate. The petitioner is a lady and is in custody since 25.08.2025, trial of the case may take considerable time and there are no criminal antecedents against the accused-petitioner, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Hamida B @ Tamanna Khan W/o Sunil D/o Shakil Ahmed, in connection with FIR No. 115/2025 registered at Police Station Ratlai, District Jhalawar, shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
