These bail applications have been filed by the accusedpetitioners under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, who have been arrested in connection with FIR No.154/2025 registered at Police Station Ranpur, District Kota City for the offences under Section 8/20 of NDPS Act.

Learned counsel for the petitioners submits that the accusedpetitioners are innocent and they have been falsely implicated in

these cases. He further submits that the alleged recovered contraband (Ganja) i.e. 4 Kg 669 gm & 4 Kg 677 gm from the possession of the accused-petitioners namely Girdharilal & Hansraj which are less than commercial quantity. He also submits that the accused-petitioners have been in judicial custody since long and the conclusion of the trial will take long time, hence the petitioners may be enlarged on bail.

Learned Public Prosecutor appearing for the State has vehemently opposed the bail applications. 4. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 5. Taking into consideration the overall facts and circumstances of the case, especially considering the fact that the alleged recovered contraband is less than commercial quantity, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 6. Accordingly, these bail applications are allowed and it is ordered that the accused-petitioners (1) Girdharilal S/o Ugmaram (2) Hansraj S/o Ugmaram be released on bail provided they furnish a personal bond in the sum of Rs.1,00,000/(Rupees One Lakh only) each with two sureties of Rs.50,000/(Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the Court concerned on all subsequent dates of hearing and as and when called upon to do so.
