This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the accusedpetitioner in respect of F.I.R. No.216/2025 registered at Police Station-Vidyadharnagar, District-Jaipur City (North) for the offences punishable under Sections 420, 406, 467, 468, 471, 120B & 384 of IPC.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant FIR, whereas no such offence has been committed by the petitioner. It is submitted that with the same facts and by giving same reference of Plot No.21, one another complaint was filed by the complainant

against husband of the petitioner in which there is no whisper whatsoever suggesting that the accused-petitioner was involved in any manner whatsoever with regard to the alleged transaction in respect of sale of plot.

It has further been submitted that the charge-sheet has already been filed against the petitioner. She is behind the bars since 01.08.2025. The offences against the petitioner are triable by Magistrate and trial against the petitioner in this case is likely to take considerably long time. Hence, benefit of bail may be granted to the petitioner. Hence, a prayer has been made to grant the bail to the petitioner.

Learned Public Prosecutor as well as learned counsel for complainant have vehemently opposed the bail application. 5. Considered the submissions made at Bar.

Further looking to the facts that the investigation in the instant case is complete and the charge-sheet has been filed by the Investigating Officer, therefore, custodial interrogation is no longer required. In addition to the above facts that on the basis of same facts one another complaint under Section 138 of the Negotiable Instruments Act, 1881, has been filed by the complainant against husband of the petitioner referring no involvement whatsoever of the petitioner and the fact that the charges are triable by Magistrate, without making any comment over the merits of the case, I am inclined to grant bail to the petitioner.

Accordingly, the Bail Application is hereby allowed. The accused-petitioner Smt. Aditi Revadiya W/o Shri Mukesh Rohila shall be released on bail in pursuance of F.I.R.

No.216/2025 registered at Police Station-Vidyadharnagar, DistrictJaipur City (North) on furnishing a personal bond of Rs.1,00,000/along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:-

(i) He shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) He shall not leave the country without prior permission of the Court.

¶30

(iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court.

In case of failure of observance of the conditions, a ground for cancellation of bail would arise.
