This instant application for bail filed under Section 483 of BNSS by the applicant-accused Ramniwas Vishnoi S/o Sukhram Vishnoi, in FIR No. 85/2024 dated 04.12.2024 registered at P.S. Special Police Station (SOG), District – ATS & SOG, Jaipur whereby the applicant-accused was charged under Sections 419, 420, 467, 468, 471, 120-B of IPC and Section 3, 4, 6 of Rajasthan Public Examination (Use of Unfair Means), Act.

The applicant was arrested and is in judicial custody since his arrest. The Court below has dismissed the bail application.

Learned counsel for the applicant relying upon grounds raised in bail application submits that the applicant is

innocent and falsely implicated in the present case. Further, he submits that on the basis of information in another case this petitioner accused is arrayed as an accused in the instant case. He further submitted that as per facts of the case Praveen Kumar appeared through dummy candidate Hanumana Ram in competitive exam and Praveen Kumar got selected. He further submitted that as per SOG present petitioner accused was middleman between Praveen Kumar and Hanumana Ram in Sub-inspector Recruitment Examination, 2021. He further submitted that there is no evidence on record except call detail between present petitioner and other accused. He further submitted that neither this petitioner is a beneficiary nor there is any evidence to show that this petitioner accused has impersonated or fabricated any record relating to Praveen Kumar. He further submitted that investigation is concluded and this petitioner accused is in custody since 21.04.2025.

Aforesaid contentions were opposed by learned Public Prosecutor and he submitted report received from Police Inspector, SOG, Rajasthan.

Heard learned counsel for the applicant-accused and learned Public Prosecutor. Perused the material placed on record.

On the basis of information SOG has found that Praveen Kumar himself has not appeared in Sub-Inspector Recruitment Examination, 2021 and he appeared through dummy candidate Hanumana Ram. As per investigation, present petitioner Ram Niwas has played role of middleman between Praveen Kumar and Hanumana Ram. Investigation

is complete and charge-sheet has been filed. This petitioner is neither a candidate who has not appeared in examination nor a dummy candidate who impersonated original candidate. The role and involvement can be considered during trial.

Upon hearing the arguments and perusing the record, we have found that the applicant-accused is no more required in the investigation and he is in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicantaccused

Thus, the instant bail application filed on behalf of applicants-accused Ramniwas Vishnoi S/o Sukhram Vishnoi, is hereby allowed and ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicant-accused shall not tamper with evidence or influence the witness in any manner.

¶30

(ii) The applicant-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

¶31

(iii) The applicant-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.
