This instant applications for bail filed under Section 483 of BNSS by the applicants-accused Sunil S/o Sh. Munshiram, Pramood Kumar S/o Sh. Bheemsingh & Hemsingh S/o Sh. Ramphal, in FIR No. 140/2025 dated 30.06.2025 registered at P.S. Tatarpur, District Khairthal, Tijara whereby

the applicant-accused has been charged under Sections 191(2), 191(3), 308(4), 109(1) of BNS and 3/25 of Arms Act.

The applicants were arrested and is in judicial custody since their arrest. The Court below has dismissed the bail application.

Learned counsel for the applicants relying upon grounds raised in bail application submits that the applicants are innocent and falsely implicated in the present case. He further submitted that cross FIR no. 139/2025 was registered at P.S. Tatarpur and to counter cross case instant case is registered by complainant. He further submitted that the facts of the case and investigation clearly indicate that not a single person sustained injury in the instant case which is sufficient to show that this is false case wherein these petitioners accused were arrayed as an accused. He further submitted that in FIR no. 139/2025 one of the person from their side has sustained injury and instead of fair investigation police has arrested these petitioners. He further submitted that the criminal antecedents shown against Hem Singh and Pramod were relating to old cases and currently there is no criminal antecedents against them. He further submitted that all these accused are in custody since 01.07.2025 and further proceeding will take its own time.

Aforesaid contentions were opposed by learned Public Prosecutor and he submitted report received from P.S. Tatarpu, District Khairthal Tijara.

Heard learned counsel for the applicants-accused, learned Public Prosecutor. Perused the material placed on record.

A report is registered on 30.06.2025 for incident of 29.06.2025. A previous FIR no. 139/2025 is also registered by accused party against complainant party. The material on record indicate that no one has sustained injury in the instant case and these petitioners accused are in custody since 01.07.2025.

Upon hearing the arguments and perusing the record, we have found that the applicants-accused are no more required in the investigation and they are in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicants-accused

Thus, the instant bail application filed on behalf of applicants-accused Sunil S/o Sh. Munshiram, Pramood Kumar S/o Sh. Bheemsingh & Hemsingh S/o Sh. Ramphal, are hereby allowed and ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicants-accused shall not tamper with evidence or influence the witness in any manner.

(ii) The applicants-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(iii) The applicants-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.

(iv) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled.

The Registry is directed to send a copy of this order to the Trial Court through E-mail.
