Learned counsel for appellant/petitioner submits that on 05.11.2024, both the aforesaid matters were listed in the court. On that day, he initially sought permission to withdraw S.B. Criminal Appeal No. 2484/2024 and accordingly order was dictated in the court. However, after some time, on the same day, his client instructed him to make a mention for adjournment of the said appeal. He requested the court and the court was kind enough to adjourn the said Criminal Appeal and directed the concerned Junior P.A. not to type the earlier order dictated to her and in both cases the date was given by the Court master.
He further submits that when he checked the next date in the matter online, it came to his notice that due to some mistake, both the matters were shown dismissed as withdrawn on the official website of the High Court, therefore, he intimated the court staff about this fact.
He further submits that now as per the instructions of his client, he wants to withdraw both the aforesaid cases i.e. S. B. Criminal Appeal (Sb) No.2484/2024 and S. B. Criminal Miscellaneous Bail Application No.11744/2024.
As prayed for, the Criminal appeal as well as Criminal miscellaneous bail application are dismissed as withdrawn. Further, office is directed to delete the wrongly uploaded order dated 05.11.2024 from the official website of the High Court.
