Rajasthan High Court (Jaipur Bench), single judge (Ashok Kumar Jain): Restoration application (S.B. Civil Restoration Application No. 202/2018) seeking restoration of Civil Misc. Restoration Application No. 1324/2011 — which itself sought restoration of S.B. Civil Second Appeal No. 105/2008 arising from suit No. 41/1995 (decreed 27.11.2003, reversed on UIT's appeal on 15.12.2007; second appeal dismissed for non-prosecution 28.01.2009; first restoration dismissed 02.08.2011 for uncured defects) — dismissed together with the accompanying application under Section 5 of the Limitation Act explaining a delay of 2378 days in refiling. The applicant's pleaded grounds — cancer and death of the original appellant Smt. Bhuri Devi (expired 07.04.2015 per death certificate) and blindness of the applicant Narendra — were found unsubstantiated: no treatment documents were filed, neither the earlier restoration application nor the Will dated 04.12.2014 recorded that she suffered from cancer, and no application was moved for three years after the Will took effect; appearances were repeatedly absent and defects remained uncured despite time granted on 05.12.2024. Drawing on the principles in Collector, Land Acquisition, Anantnag v. Katiji (AIR 1987 SC 1353), Balwant Singh v. Jagdish Singh (2010 (8) SCC 685) (referring Union of India v. Ram Charan, AIR 1964 SC 215), Brijesh Kumar v. State of Haryana ((2014) 13 SCC 291) (referring Esha Bhattacharjee, (2013) 12 SCC 649), P. Subba Reddy (2024 INSC 286) and H. Guru Swamy (2025 INSC 53), the Court held there was no sufficient cause to condone the inordinate, unexplained delay; no order as to costs.
