Heard on the application for condonation of delay which occurred in filing the restoration application.

Considered the submissions.

In view of the submissions made by learned counsel for the appellant and for the reasons mentioned in the application, the Court deems just and proper to condone the delay.

Accordingly, the application for condonation of delay is allowed and the delay of 893 days which occurred in filing the restoration application, is condoned.

Application No. CMCC 1076/2021 stands disposed of. Heard on application No. 122/2021 for restoration of appeal No. 5268/2018.

Learned counsel for the applicant submits that the aforesaid appeal was dismissed on 30.04.2019 in furtherance of peremptory order dated 22.02.2019 for not curing the defects.

Having regard to the submissions made by counsel for the applicant-appellant and for the reasons mentioned in the application for restoration, the same is allowed subject to payment of cost of Rs.2,000/- to be deposited with the Rajasthan High Court Munshi Sangh, Jaipur Bench, Jaipur.

On submission the receipt of deposited amount with the Registry, the Civil Misc. Appeal No.5268/2018 is directed to be restored to its original number.
