Instant restoration application has been filed for restoring S.B. Civil Writ Petition No.6236/2021, after recalling peremptory order dated 13.04.2022 passed by the Coordinate Bench and the order dated 28.11.2022 passed by the Registrar (Judicial), dismissing the petition for non compliance of the order dated 13.04.2022.

Counsel for petitioners submits that due to bona fide error the notices could not be filed within period. 3. Counsel for the petitioners undertakes to file complete extra sets and notices immediately on restoration of the petition. 4. Taking into consideration reasons mentioned in the application and undertaking of counsel for petitioner to file complete extra sets and notices, this Court is inclined to allow the present restoration application, subject to deposition of cost.

Accordingly, the S.B. Civil Writ Petition No.6236/2021 is allowed to be restored to its original number, subject to condition of deposition of a cost of Rs.1,000/- with the Litigants Welfare Fund through Cheque/DD in the name of Registrar General LWFA, Rajasthan High Court within a period of four weeks. Receipt of deposition of cost amount be placed in the file. The petitioner is directed to file complete extra sets and notices within a period of 7 days.
