Instant application has been filed for restoring S.B. Civil Writ Petition No.18364/2023, after recalling peremptory order dated 20.12.2023 passed by the Coordinate Bench and the order dated 22.01.2024 passed by the Registrar (Judicial), dismissing the petition for non compliance of the order dated 20.12.2023.

It has been submitted that the writ petition has been dismissed due to non compliance of the order dated 20.12.2023, for not taking necessary steps to remove the defect pointed out by the Office. Counsel for petitioners submits that documents to remove such defects, were filed in the Office on 22.12.2023, but because such documents were not traceable in the Office, the petition came to be dismissed.

Counsel for petitioners undertakes to remove the defect(s) pointed out by the Office within a period of three weeks, soon after on restoration of the petition.

Taking into consideration reasons mentioned in the application and undertaking of counsel for petitioner to remove the defect(s), this Court is inclined to allow the instant application. 6. Accordingly, the S.B. Civil Writ Petition No.18364/2023 is allowed to be restored to its original number. The petitioners are directed to remove the defect(s) pointed out by the Office within a period of three weeks.

Accordingly, the instant application is allowed.
