It is informed by learned Additional Govt. Advocate that victim has been intimated about filing of the appeal and application for suspension of sentence. Report in this regard has been submitted by learned Additional Govt. Advocate and the same is taken on record.

No one has put in appearance on behalf of victim. 3. Applicants have preferred these second applications for suspension of sentence. 4. Heard on second applications for suspension of sentence. 5. It is contended by counsel for the applicants that the earlier application for suspension of sentence was rejected on the ground that application for suspension of sentence of Kuldeep and Akash was rejected by the Court and the case of the present applicants is akin to that of Kuldeep and Akash. It is also contended that now the application for suspension of sentence of Kuldeep and Akash has been allowed by the Court vide order dated 09.04.2024.

Learned Additional Govt. Advocate has opposed these second applications for suspension of sentence.

We have considered the contentions.

Taking note of the fact that similarly situated co-accused has been allowed by this Court, we deem it proper to allow these second applications for suspension of sentence.

Accordingly, these second applications for suspension of sentence application is allowed. It is ordered that the sentence awarded to applicants in Sessions Case No.19/2017(CIS No.17/2021) shall remain suspended if the applicants furnish a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/-
