Accused-applicant has preferred this second application for suspension of sentence.

Heard on second application for suspension of sentence.

It is contended by counsel for the applicant that applicant has remained in custody for a period of about 8 years. Disposal of appeal is bound to take time.

Learned Additional Govt. Advocate has opposed the second application for suspension of sentence. It is contended that victim in this case was aged about 4 years. It is also contended that first application for suspension of sentence was dismissed on merits.

We have considered the contentions.

Taking note of the fact that first application for suspension of sentence was dismissed considering the statements of Dr. Jai Singh Kathana and Dr. Manmohan Sharma; that there was teeth bites on the cheeks and chest of the victim and small gap was found between the teeth of accused; that doctor has clearly stated that marks of the bite found on the person of the victim were matching with the teeth structure of the accused and no other ground except custody period has arisen, hence, we are not inclined to entertain the second application for suspension of sentence.

Criminal Misc. Second Suspension of Sentence is accordingly, dismissed.
