Accused-applicant has preferred this application for suspension of sentence.

Heard on application for suspension of sentence.

It is informed by learned Addl. G.A. that complainant/victim has been intimated about filing of the application for suspension of sentence. Despite intimation, no one has put in appearance on behalf of the complainant/victim. Report in this regard has also been submitted and the same is taken on record.

It is contended by learned counsel for the appellant that appellant has remained in custody for a period of five years.

Dispute took place between real brothers with regard to fencing on farm land. There was an allegation of causing injury on the head of the deceased, who has expired. Petitioner is the nephew of the deceased. Disposal of appeal will take time.

Learned Additional Govt. Advocate has opposed the Suspension of Sentence Application. 6. We have considered the contentions.

Taking note of the fact that allegation on the petitioner is of causing injury by an axe, however, as per statement of PW-7, there is no sharp injury caused to the deceased; the dispute took place between real brothers on account of fencing on farm land; petitioner has already remained in custody for a period of five years; disposal of appeal will take time, we deem it proper to allow the application.

Accordingly, the suspension of sentence application is allowed. It is ordered that the sentence awarded to accused/applicant in Sessions Case No. 35/2020 shall remain suspended if the accused/applicant furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each to the satisfaction of the learned trial Court to the effect that he shall appear before this Court as and when called upon to do so.
