This intra court appeal is preferred by the appellant being aggrieved with the order dated 22.04.2022 passed by the learned Single Judge in S.B. Civil Writ Petition No.9393/2021, whereby, the learned Single Judge has dismissed the writ petition filed by the petitioner.
The learned Single Judge has taken into consideration the fact that the respondents were required to operate the reservation meant for SC & ST category while maintaining the ratio of 70:30 between medico/non-medico candidates. It is held that on account

of that selection of a non-medico ST candidate, having lesser mark than the appellant, cannot be faulted.
The learned Single Judge has given this finding while taking into consideration the note appended to the advertisement, which suggests that 70% posts are required to be filled up by medico persons and 30% posts are required to be filled up by non medico persons. It is also clearly specified in the note that firstly 70% medico persons would be selected against the advertised posts and on remaining posts medico/non-medico persons can be selected on the basis of merit.
Having gone through the order of the learned Single Judge as well as the note appended to the advertisement, we do not find any illegality in the impugned order.
Hence, this special appeal lacks merit is hereby dismissed.
The stay petition also stands dismissed.
