Petitioner has preferred this habeas corpus petition seeking custody of his minor daughter aged 2 years and 9 months who is in custody of maternal grand-father.

It is contended by counsel for grand-father that they are willing to give custody of child.

¶21

It is contended by counsel for petitioner that he will lookafter the child and as he is in transport business he cannot spare money and can deposit monthly amount in Suknaya Yojna.

Counsel for respondent and maternal grand-father states that if FD is made they will have no objection to the child being given in custody to the petitioner. 5. We have considered the contentions.

During Court proceedings, petitioner was asked to take the child and the child has willingly gone in the lap of her father. As such we do not think that giving of custody of child to father will cause any mental disturbance to the child as she is willing to go in the lap of her father and sister-in-law of petitioner.

Custody of child is handed over to petitioner-father, however, petitioner as agreed will make FD of Rs.3 lac in favour of his daughter within a period of one month.

Petitioner has agreed to make FD of Rs.3 lac in favour of his daughter and such FD shall not be encashed before she attains majority. Petitioner is also directed to permit maternal grandfather of the child to meet the child once a month.

Consequently, habeas corpus petition stands disposed.
