This petition is filed seeking directions to the respondent to issue sanction order in favour of the petitioner for grant of mining lease on the land admeasuring 3.9537 hectare situated near Village Roopaheli, Tehsil Malpura, District Tonk.

The relevant facts are that the petitioner-firm filed an application on 06.09.2021 for grant of mining lease for the Granite. During the processing of the application, the petitioner was asked to furnish undertaking of not conducting the mining operations as well as the excavation activities within the radius of forty five meters from the canal passing near the site-in-question. An affidavit was furnished and Letter of Intent (LOI) dated 27.09.2021 was issued. As per condition of LOI, the petitioner had to furnish security deposit and performance security along with environmental clearance certificate. The petitioner complied with both the conditions as is evident from communication dated 21.03.2023 addressed by the Assistant Mining Engineer to the Additional Director Mines, Jaipur. Communication dated 24.03.2023 was issued asking for undertaking as per Rule 28 (XVI) of the Rajasthan Minor Mineral Concession Rules, 2017 (for short 'the Rules').

Learned counsel for the petitioner submits that the undertaking in compliance of Rule 28 (XVI) of the Rules had already been furnished, yet the mining lease is not being sanctioned.

This petition is disposed of directing the respondent No.3 to consider and decide the case of the petitioner within six weeks from the date of receipt of certified copy of this order. In case there is deficiency, the petitioner shall be given notice for complying the same. 5. The writ petition is accordingly disposed of.
