Heard learned counsel for the parties.

Learned counsel for the parties are in agreement that without going into the merits of the matter, the writ petition may be disposed of with a direction to the Assistant Collector-cumSDO, Jaitaran to decide the pending application preferred under Order 39 Rule 1 & 2 at the earliest.

Learned counsel for the respondents submits that he has preferred an application for impleadment as party respondent

before the learned trial court and he prays that the same may also be considered and decided at the earliest.

Considering the submissions made before this Court, the writ petition is disposed of by setting aside the order dated 22.04.2024 passed by the Board of Revenue, Rajasthan, Ajmer. The Assistant Collector-cum-SDO, Jaitaran is directed to decide the pending application preferred under Order 39 Rule 1 & 2 in the suit proceedings undertaken by the petitioner at the earliest, preferably within a period of six weeks from the date of receipt of this order, strictly in accordance with law.

The learned trial court is also directed to consider and decide the application preferred by the counsel for the respondent for impleadment as party respondent.
