Learned counsel for the petitioner submits that the petitioner would be satisfied if his representation is considered and decided by the respondents, while keeping into consideration the order passed by this Hon’ble Court in Shakti Singh & Anr. Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.19047/2022 decided on 02.02.2023) . The order reads as under:-

“Learned counsel for the respective parties submit that the issue involved herein is no more res integra and stands resolved by an order of this Court dated 14.03.2022 in SBCWP No.1964/2022: Zabir Khan Vs. State of Rajasthan & Ors. and other connected matters. They submit that this writ petition may also be disposed of in similar terms barring the direction No.1 inasmuch as the amnesty scheme is no more in force.

Taking into consideration the contentions advanced by learned counsels for the respective parties and the material on record, the writ petition is disposed of in terms of order dated 14.03.2022 passed in case of Zabir Khan (supra) which shall apply mutatis mutandis to this case also barring the direction No.1.

The present writ petition is disposed of on the submission made by the learned counsel for the petitioners that the writ petition is squarely covered by the judgment of this Court passed in Zabir Khan (Supra) and if the authorities find that the facts in the present case are not similar to the case of Zabir Khan (Supra), they may proceed against the petitioners in accordance with law.”

In view of the above, the present writ petition is disposed of with a direction to the respondents to consider and decide the representation of the petitioner, while keeping into consideration the order passed in Shakti Singh (supra) by passing a speaking order, strictly in accordance with law. Stay petition also stands disposed of.
