Heard learned counsel for the parties.

Learned counsel for the parties, without joining the issues on merit, submit that the Board of Revenue has passed the order dated 22.04.2024 withing giving an opportunity of hearing to the petitioner, therefore, the order dated 22.04.2024 is not sustainable in the eyes of law.

Learned counsel for the parties are in agreement that the Revenue Appellate Authority, Jodhpur may be directed to decide

the pending appeal of the respondents within a period of one month and till the appeal is decided, the petitioners may not alienate the property in question.

Considering the submissions made before this Court, the order dated 22.04.2024 passed by the Board of Revenue, Rajasthan, Ajmer in Revision Petition No.2087/2024 is quashed and set aside and the Revenue Appellate Authority, Jodhpur is directed to decide the pending appeal No.48/2024 “Chuka Ram Vs. Amararam” within a period of six weeks from the date of receipt of the certified copy of this order, strictly in accordance with law.

Till the pending appeal is decided by the Revenue Appellate Authority, Jodhpur, the petitioners shall not create any third party rights over the property in question and shall not alienate the same.

The writ petition as also the stay petition stand disposed of in the above terms.
