At the outset, learned counsel for the petitioners makes a limited prayer that the petitioners may be given one last opportunity to lead evidence upon depositing a cost of Rs. 15,000/- within a particular time frame.

Learned counsel for the respondents submits that since there is a delay on the part of the petitioners in filing the application therefore, the prayer may be rejected.

In view of the above and in the interest of justice as a last opportunity, this Court deems it appropriate to direct the

petitioners to deposit a cost of Rs.15,000/- to the respondents for the proceedings in the Civil Misc. Case No. 23A/2016 (Nirmla Devi Vs. Umesh Kumar & Anr.) pending before the learned Additional District Judge, Raisinghnagar and the petitioners are also directed to keep with them witness(es) ready along with the affidavit(s) on the next date of hearing which is on or before 01.5.2024 for their examination/cross-examination and upon doing so, the Court below is directed to permit the petitioners to lead evidence in the Civil Misc. Case No. 23A/2016 (Nirmla Devi Vs. Umesh Kumar & Anr.) pending before the learned Additional District Judge, Raisinghnagar.

With the aforesaid observation, the writ petition is disposed of. Stay petition and all pending applications, if any, stand disposed of.
