1. This writ petition has been filed on behalf of the petitioner in

public interest claiming following reliefs :-

“I. It is, therefore, humbly and respectfully prayed that by an appropriate writ, order or direction, the plying of roadways and private buses/heavy/commercial vehicle operated in front of Gandhi Bal Niketan School, Raghunath School and Government Hospital, Ratangarh Via Underbridge No.1 may kindly ordered to be restrained.

II. By appropriate writ, order or direction the respondents may kindly be directed to restrain parking/illegal parking of cars, jeeps, autorickshaws, light commercial vehicles on the station road, road between Shri Gandhi Bal Niketan and Shri raghunath Vidhyalaya towards pulia (under-bridge) no.1 and on road from pulia (under-bridge) no.2 to Nagarpalika including side lane of Bus Stand in front of Sub Jail.

III. By appropriate writ, order or directions the respondents may kindly be directed to strictly adhered to orders passed earlier and the said vehicles may kindly be ordered to be plied on the alternative/link road/designated roads.”

2. This Court passed various orders from time to time, however

on 12.01.2023, the District Collector, Churu joined the hearing through video conferencing and after hearing him, this Court passed the following order :-

“The District Collector, Churu joined the hearing through VC. He submits that he has explored the possibilities to de-congest the road in question and has

come out with certain suggestions and solutions, which shall be filed on record by the next date of hearing.

He further submits that some of the solutions have already been applied and resulted into significant decongestion of the road in question.

A possibility was also considered of shifting the existing roadways bus-stand to an open area outside the town but because of the dire financial condition of the RSRTC, the officials of the Corporation have expressed their helplessness in accepting or carrying out this suggestion.

We feel that the market value of the land where the bus-stand is presently located will be much more than what would be required for establishing a bus-stand outside the town. The possibility of shifting the bus-stand may also be considered in the intervening period.

Learned AAG Mr. Sunil Beniwal has submitted that though the respondents have explored the possibility of shifting the Bus Stand outside the town but the same is not possible looking to the distance of the earmarked place for Bus Stand from the town, which is around 12 Kms. It is also submitted that the Rajasthan State Road Transport Corporation (hereinafter to be referred as ‘the RSRTC’) is not having funds for establishing a new Bus Stand and, therefore, the possibility of shifting the existing Bus Stand from Ratangarh is very bleak

4. However, learned AAG Mr. Beniwal has assured this Court that as and when the situation will improve RSRTC will consider for shifting the Bus Stand in future.

5. So far as de-congestion of Railway Station Road of town Ratangarh, which is main road of the town, is concerned, learned AAG has assured this Court that regular attempts to

de-congest the said road by removing private taxis and private buses will be carried out by the administration and the administration will make sure that the main road of town Ratangarh may not be congested with the illegal parking of private taxis, jeeps and buses.

6. In view of the above assurance given by learned AAG, we are of the view that no further order is required to be passed in this writ petition, which has been filed in the public interest. However, it is expected that the respondent authorities will remain vigilant and make every efforts to de-congest the Railway Station Road of town Ratangarh with the illegal parking of the private vehicles.

7. With these observations, this writ petition is disposed of.
