The instant writ petition has been filed by the petitioner with

the following prayer:-

“I) By an order of writ of mandamus, or by an appropriate, order or direction, the Respondents may kindly be directed to release/make the payment of Gratuity, Arrears of 5^th and 6^th Pay Commission, Arrears of EL, Overtime, GH, Weekly Rest, Night Rest Charges/Due rest, benefit of Arrears of selection scale of completion of 18 and 27 years of service with 9% Interest per annum. The heavy cost be imposed upon the respondents.

II) Any other order which this Hon’ble Court deemed just and proper in the facts and circumstances of the case may also be passed in favour of the petitioner.”

Learned counsel for the respondents apprised this Court that

the relief sought for in this petition has already been provided by

the respondents, thus no cause of action survives with the petitioner. Hence under these circumstances, this writ petition has become infructuous.

Per contra , learned counsel for the petitioner submits that still certain dues and the amount of interest is liable to be paid by the respondents.

In view of the aforesaid submissions made by learned counsel for the parties, the instant writ petition stands disposed of with a direction to the respondents to make payment of dues/interest, if any, in terms of the circular dated 03.11.2021 passed by the respondent-corporation.

All applications (pending, if any) also stand disposed of.
