The matter comes up on an application for early hearing of case.

The application is dismissed as the main case is already fixed today.

With the consent of learned counsel for the parties, the matter is taken up on the Board.

This petition was filed challenging of demand letter dated 24.05.2002. Further direction was sought for renewal of the composite bar license in the existing category-C.

The brief facts are that the petitioner is running a Hotel and had a Bar license for the year 1998-1999 and 2000-2001.

As per pleaded facts, hotel of the petitioner was being treated as ‘Heritage Hotel’ Category-C. Subsequently a Committee was constituted and category was changed to Heritage Category ‘A’. Consequently, the impugned notice was issued for renewal fee of Heritage Category ‘A’.

Learned Senior Counsel for the respondents submits that during pendency of the writ petition, the representation made by the petitioner was considered and vide order dated 08.07.2002 the Hotel was held to be falling under Heritage Category ‘B’.

Counsel for the petitioner is not disputing the contentions raised by Senior Counsel for the respondents.

In view of the above, the petition is disposed of with liberty to the petitioner to avail remedies in accordance with law if aggrieved of order dated 08.07.2002.

Needless to say that the respondents shall be at liberty to pursue the recovery proceedings in pursuance to the order dated 08.07.2002.
