These three petitions are being disposed of by this common order as the facts and issues involved are similar.

For convenience, the facts are being taken from S.B. Civil Writ Petition No.3220/2021.

The challenge in the present petition is to the show cause notice (for short ‘the SCN’) dated 08.02.2021 issued under Section 39 of the Rajasthan Municipalities Act, 2009. The SCN was issued to the petitioner to show cause within fifteen days for behaviour with municipal employees and making the caste base remarks. The backdrop was that the petitioner was municipal councillor and the proceedings were initiated for removal of encroachment, for the incidents occurring during the removal of encroachments, two FIRs were registered.

Notice of motion in the case was issued on 25.03.2021 and the respondents were restrained to proceed further in pursuance of the notice dated 08.02.2021.

Considering that the writ petition has been filed against SCN and the petitioner without even responding to the SCN, has approached this Court, these petitions are disposed of with liberty

to the petitioners to file a response to the show cause notice within three weeks from today and the respondents shall proceed in pursuance to the show cause notice dated 08.02.2021 in accordance with law, following the procedure and after taking into consideration the reply, if filed.
