“That, so far as judgment passed by this Hon’ble Court in SBCWP No.2778/2012 on dated 08.04.2015 is concerned, it would be relevant to submit here that aforesaid judgment has been passed by this Hon’ble Court without considering important aspect of the matter that the advertisement issued on dated 17.06.2011 was only for those candidates who were working in the revenue (land records) department and not for candidates of colonization department as well as settlement department and not only this, by way aforesaid recruitment process, neither the vacancies determined and declared to be fill up by way of competitive examination of colonization department and nor any such vacancies were available there. However, it would be relevant to submit here that the judgment passed in Vijay Kumar’s case also materially affects the rights of the petitioner wherein, it would be relevant to submit here that the advertisement in question was issued for the candidates who were serving in the revenue (land records) department against the vacancy of the same department and resultantly, the humble petitioner as well as similarly situated candidates of the colonization department and settlement department could not participate in recruitment process and they have not provided equality as well as reasonable opportunity to participate in recruitment process and as such, by the same recruitment process, the seniority of the petitioner as well as other candidates of the colonization and settlement department cannot be snatched forcibly.
