After death of the brother of the petitioner, the mother of the petitioner submitted an application for granting compassionate appointment within the reasonable time but the same was not considered. Hence at the later stage, i.e. on 01.04.2022, the mother of the petitioner requested the respondents to consider the claim of the petitioner for appointment on compassionate grounds in her place. The application filed by the petitioner has been rejected by the respondents vide impugned order dated 13.09.2022 on technical count that the brother of the deceased cannot be treated as dependent under the Rules of 1996 and the amended Rules of 1966 came into effect with effect from 28.10.2021 and accordingly, the claim of the petitioner was rejected by the respondents. The instant case is a glaring example where the petitioner has not only lost his father but also his brother within a short span. Thereafter, being dependent on the deceased brother, he submitted an application seeking appointment on compassionate grounds but the said application was kept pending by the authorities and the same was not decided and in the meantime, the Government of Rajasthan, amended the Rules of 1996 vide notification dated 28.10.2021 and this time brother of the deceased employee was also treated as dependent upon the deceased brother, who was serving in the Department at the time of his death.
