Learned counsel for the petitioner submits that on completion of satisfactory period of probation, the petitioner was granted the regular pay scale by the respondents vide order dated 30.05.2024. Learned counsel submits that the respondents have issued an order dated 12.09.2024 (Annex.15) withdrawing the benefit of the regular pay scale granted to him without affording

any opportunity of hearing. The order dated 12.09.2024 has civil and evil consequences and, therefore, the opportunity of hearing in the matter is required to be given in compliance of the principle of natural justice.
Matter requires consideration.
Issue notice. Issue notice of the stay application also, returnable on 24.10.2024.
Shri Parvat Singh Panwar, DySG, appears for the respondent No.4 and seeks some time to complete his instructions/file reply.
Time prayed for is allowed.
List the matter on 24.10.2024.
In the meanwhile and till the next date of hearing, no recovery shall be effected from the petitioner in pursuance of the order dated 12.09.2024.
It is made clear that the respondents will be free to apply for vacation/modification of this interim order by filing an appropriate application.
