The present bail application under Section 439 of the Code of Criminal Procedure has been filed by the applicant, who is in custody in connection with the FIR No.291/2023 registered at Police Station Rawala, District Sri Ganganagar for the offences punishable under Sections 8/21 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the applicant submitted that the applicant has been en-roped on the basis of the statement of principal accused and even the quantity recovered from him (the principal accused) was below commercial quantity ( 35 gram Heroin ).

He further submitted that charge-sheet has been filed and prayed that the applicant be enlarged on bail.

Learned Public Prosecutor opposed the bail application by contending that there is one more case of like nature pending against the present applicant.

Heard learned counsel for the parties and perused the material available on record.

Admittedly, the applicant has been inculpated on the basis of the statement of co-accused; that apart the quantity recovered from the principal accused is below commercial.

True it is, that there is one more case of like nature pending against the applicant, but considering that he has been enlarged on bail in such case and that the charge-sheet has been filed and the trial will take substantial time, the bail application of the applicant, who is behind bars since 28.12.2023 is allowed.

Consequently, the present bail application filed under Section 439 of the Code of Criminal Procedure is allowed. It is ordered

that the applicant – Ramesh Singh @ Bittu S/o Chana Singh arrested in connection with FIR No.291/2023 registered at Police Station Rawala, District Sri Ganganagar shall be released on bail; provided he executes a personal bond in the sum of ₹1,00,000/and two sound and solvent sureties of ₹50,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
